UK Vehicle Insurance - Who Pays For Emergency Treatment?

We're looking at a selection of the clauses in a British vehicle insurance policy. In this instance it's the "Emergency Treatment" clause and it deals with who is responsible for any medical attention needed as the result of a motoring accident.

Current UK laws dictate that you must pay treatment fees to the first medical practitioner to give you treatment in an accident. This is part of the Road Traffic Act. People have been known to refer to this as a charge for an ambulance. In reality this is not true but in reality it is normally the ambulance paramedics who provide the care and the account comes to you from the N H S region that sent the ambulance and its crew.

YOU MUST PAY THIS BY LAW irrespective of who is blamed for causing the accident. Your insurance company will meet the cost under this section. Just send the invoice on to them and they will remit it straight to the N H S trust. Alternatively you can pay it out of your own pocket and get your insurance company to reimburse you.

It is not impossible that in a busy insurance office, the claims staff could overlook the invoice if you have sent it in amongst other forms. It's possible that you could receive a reminder from the N H S trust that the invoice remains unpaid. Tell the N H S Trust who your insurance company are and telephone your claims office. Be firm but please don't lose your temper.

The insurance company paying this account will not in fact affect your no claims bonus. It is not dealt with as a claim. So, in the unlikely event that your insurance company were to pay the medical treatment invoice and nothing else then your bonus would remain intact. In reality, in a road traffic accident where a person is hurt, it is highly improbable that there is no other types of claim to be met.

Theoretically, if someone else is at fault for the accident you can send the invoice on to their insurer but you are just asking for unnecessary hassle. My advice is, don't bother. It makes no difference to you either way.

Owing to recent changes in the law, hospitals now also charge insurers for treatment given to third party accident victims, with certain limitations applied. These are claimed by the NHS Trust in cases where you were to blame for the accident and another person has had treatment for an injury that you caused. THIS HAS PUSHED UP THE COST OF CLAIMS SETTLEMENTS AND CONSEQUENTLY YOUR PREMIUMS. Some of those inside the insurance industry consider that this is a further case of "stealth tax" taxation by the Government.
